2020年4月1日より労働契約法第20条は同法から切り離され、『パートタイム契約法』（短時間労働者の雇用管理の改善等に関する法律）が新たに『短時間労働者及び有期雇用労働者の雇用管理の改善等に関する法律』となって同法第8条に統合されました。昨日の2つの判決は非正規労働者に対する賞与や退職金の不払いが旧労契法20条違反かどうかについて争われた最高裁の判示であり、今後の同様の訴訟に関して一定の影響を与えるものと思われます。しかし今回の判決は同時に、経営者側の支払う賞与や退職金の定義やその根拠について今後は経営者側によるしっかりとした説明が必要となることを示唆しており、例えばもし賞与が単なる給与の補助的な支給に留まるものであるならば、今後の訴訟ではその差別の不合理性が認められる可能性もあり得ましょう。その意味で同一労働同一賃金の意味と、それに対する対価に関しては今後も法廷を通して個別具体的に精査、判断されると思います。（2020年10月14日）
The top court rejected the provision of the bonus and retirement payments to nonregular employees although he confirmed that the difference of the treatment from regular employees should be reasonable. The judgement was made by the supreme court yesterday. This decision will influence to the following court cases more or less, while it should be examined individually concretely. Besides, however, companies will be severely required to define the meaning and the structure of these systems, i.e. bonus and the retirement payment, so that they can justify the different systems for nonregular employees in advance from now on.
